Acceptance of these terms
These terms govern your use of growerfolks.com (the “site”), which is operated by Grower Folks Pvt. Ltd. (“Grower Folks”, “we”, “us”). By browsing the site or contacting us through it, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.
Use of the site
The site exists to tell you about Grower Folks, our services and our work. You may browse it, share links to it and quote short passages with attribution. You agree not to:
- copy, scrape or republish the site’s content or design, in whole or in part, without written permission;
- use the site or the contact channels on it to send spam, unsolicited offers or unlawful material;
- attempt to gain unauthorised access to the site, its hosting or any connected service, or to interfere with its operation;
- present the site or our work as your own or as endorsing you without our agreement.
Intellectual property
All films, animations, designs, photographs, illustrations, text, logos and code on this site are owned by Grower Folks Pvt. Ltd. or by our clients and licensors, and are protected by copyright, trade mark and other intellectual property laws. The Grower Folks name and the “G” mark are trade marks of Grower Folks Pvt. Ltd. Nothing on the site grants you a licence to use any of this material except as set out in these terms.
Client work and logos
Project stills, films and campaign material shown on the site are examples of work produced for our clients and are displayed with their permission. Client names and logos are the property of their respective owners, appear only to identify the brands we have worked with, and do not imply any endorsement of your use of the site. If you are a client and would like a piece removed or updated, contact us and we will act promptly.
Proposals and engagements
Information on the site, including descriptions of services and the process we follow, is general and does not constitute an offer. Every project is governed by a written proposal, statement of work or agreement that sets out scope, deliverables, timelines, fees and the ownership of the work produced. Where those documents and these terms differ, the project documents prevail for that project.
Replies to enquiries, estimates and strategy conversations are given in good faith and may change once we understand your requirements in detail.
Fees, payment and cancellation
Fees, payment schedules, advance payments and cancellation terms are set out in each project agreement. Unless it says otherwise, invoices are payable within the period stated on them, work may be paused while an invoice is overdue, and advance payments cover work already begun and are not refundable. Media spend on advertising platforms is separate from our fees and is paid to the platform directly or reimbursed to us at cost.
Third-party links and platforms
The site links to third-party platforms such as Instagram, Behance, Dribbble, Facebook, X and WhatsApp. Those services have their own terms and privacy policies, we do not control them, and we are not responsible for their content or practices. A link does not mean we endorse the destination.
Accuracy and availability
We work hard to keep the site accurate, current and available, but it is provided “as is” and “as available” without warranties of any kind, express or implied. We may change, suspend or remove any part of the site at any time without notice. Results described in case studies and testimonials are specific to those clients and campaigns and are not a promise of similar results for you.
Limitation of liability
To the fullest extent permitted by law, Grower Folks is not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising from your use of, or inability to use, the site or reliance on its content. Nothing in these terms limits liability that cannot be limited by law, including liability for fraud. Liability in connection with a project is governed by that project’s agreement.
Governing law
These terms are governed by the laws of India. Any dispute arising from them or from your use of the site is subject to the exclusive jurisdiction of the courts of Kochi, Kerala. We would rather talk first: if something has gone wrong, contact us and we will try to resolve it directly.
Changes to these terms
We may revise these terms from time to time. The date at the top of this page shows when they were last updated, and the current version applies from the moment it is published. Continuing to use the site after a change means you accept the revised terms.
